Terms of Sale

These terms of sale govern every paid subscription and token purchase on PricklyMails. They apply to both consumers and business customers. By completing a purchase you accept them in full.

1. Purpose

These terms define the conditions under which PricklyMails sells access to its email-verification service through monthly subscriptions and one-time token top-ups. They complement the Terms of Service, which govern use of the service.

2. Seller

The service is sold by Hugo Deltour, a micro-entreprise (sole trader) with registration in progress, contact hugodeltour.pro@gmail.com. The service is hosted in the European Union by Hetzner Online GmbH, Germany.

3. Offers and prices

Access is sold as monthly plans (Starter, Pro, Business, Enterprise), each granting a monthly amount of tokens, and as one-time token top-ups. Prices are shown in euros on the pricing page. As the seller benefits from the VAT exemption for small businesses, VAT is not applicable (article 293 B of the French General Tax Code); prices are therefore net of VAT. Prices may change with prior notice; a change never affects an order already placed.

4. Order and payment

Orders are placed online and paid in advance through our payment provider, Stripe. Subscriptions renew automatically each month (or each year for an annual plan) until canceled. A receipt is issued for every payment.

5. Tokens

Tokens are a prepaid virtual unit used to pay for verifications; a verification consumes tokens according to the checks enabled. Purchased tokens do not expire and are not transferable between accounts. They have no monetary value outside the service and cannot be exchanged for cash.

6. Right of withdrawal

A consumer has a 14-day right of withdrawal. Because the service is supplied immediately, you are asked to expressly waive this right at checkout so that your tokens are available at once; once you have done so and the service has begun, the right of withdrawal no longer applies. The right of withdrawal does not apply to business (professional) customers.

7. Cancellation

You may cancel a subscription at any time from your dashboard. Cancellation stops the next renewal and takes effect at the end of the current paid period; you keep the service and your tokens until then, and your tokens do not expire afterwards. No partial refund of the current period is due on cancellation, subject to the guarantee below. This is without prejudice to the statutory guarantees described in the Statutory guarantees section.

8. Subscription renewal and cancellation

Subscriptions run for the chosen term (monthly or annual) and renew automatically for successive terms of the same length. In accordance with article L215-1 of the French Consumer Code, you may cancel the renewed contract at any time after its renewal, with effect at the end of the current period. For annual subscriptions, PricklyMails informs you in writing, no earlier than three months and no later than one month before the renewal deadline, of your right not to renew. In accordance with article L215-1-1, cancellation can be carried out online at any time and free of charge from your dashboard, through a feature as simple as subscribing.

9. Refunds

Tokens spent on a verification that does not technically complete are not charged. Beyond that, refunds are granted in good faith, in proportion to the unconsumed balance, and may be declined in the event of manifest abuse. Requests are sent to hugodeltour.pro@gmail.com.

10. Availability

The service is provided on a best-effort basis. Maintenance or incidents may cause temporary interruptions. Planned maintenance is announced where reasonably possible.

11. Liability

To the extent permitted by law, the seller's total liability arising from the service is limited to the amounts you paid over the twelve months preceding the event giving rise to the claim. The seller is not liable for indirect or consequential damages.

12. Statutory guarantees

The service is provided subject to the applicable statutory guarantees. As a consumer you benefit from the legal guarantee of conformity (articles L217-1 et seq. of the French Consumer Code, which apply to digital content and services) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). Under the legal guarantee of conformity, you have two years from the supply of the service to obtain its conformity, free of charge and without major inconvenience. Any exclusions or limitations of liability set out herein apply only to the extent permitted by law and without prejudice to these statutory guarantees, which cannot be waived.

13. Personal data

Personal data is processed as described in our Privacy Policy. Verified email addresses are never stored (zero retention).

14. Governing law and mediation

These terms are governed by French law. In accordance with article L616-1 of the French Consumer Code, in the event of a dispute not resolved directly with us, a consumer may, before any legal action, refer the matter free of charge to a consumer mediator. The competent mediator is being appointed; its details will be published here before any paid offering opens. Failing an amicable settlement, the competent courts are those provided for by the applicable rules.
